What Lawsuit Does K-V Pharmaceutical Settle ?

       K-V Pharmaceutical settles a lawsuit that was filed on August 21, 2012, against the Illinois Department of Healthcare and Family Services over orphan drug Makena’s pricing. In that lawsuit, K-V Pharmaceutical said that the Illinois Department “was unfairly blocking Medicaid patients’ access to Makena”.  

        In the August 21, 2012 lawsuit, K-V Pharmaceutical stated that their “ …. survival as a going concern is now dependent on Makena’s success, with a substantial portion of its potential market being for the treatment of Medicaid patients ….. unless injunctive relief is ordered, KV’s available cash will soon be depleted, KV may cease to exist, and Makena may no longer be available to pregnant women …”. 

         The out-of-court settlement terms were not made public. Makena will now be covered by the Illinois Medicaid program.
